In accordance with the Law of April 30, 2014 on consumer rights, in case of a gift card purchase, both in its physical form (i.e. a plastic card) as well as a code sent by email, the Customer is entitled to exercise the related rights to withdraw from the agreement within 14 calendar days from the date of the purchase of the card. The right to withdraw from the agreement on the basis of the law on consumer rights does not derive from the type of the agreement entered into (e.g. the fact that the purchase of a gift card is not a taxable transaction) but from the fact of ordering the gift card through the Internet.
In case when the value allocated to the card has been partially redeemed before the expiry of the term of the right to withdraw from the purchase agreement, the Consumer still cannot be refused the right to withdraw from the agreement, with one reservation, that the amount redeemed may be refused to be returned. The necessary condition here is to advise the Consumer of the fact by including the appropriate clause in the Internet Shop regulations.
However, it is also a necessary condition to clearly advise the Consumer that he/she is not entitled to the right to withdraw from the gift card purchase agreement entered into via the Internet in case of complete redemption of the value of the gift card before the expiry of the agreement withdrawal period.
